Abstract

The Niqab calm problem can be viewed from two sides, namely external and internal. The external side is the impact of the hegemony of Western civilization that brings people to the denial of the Shari'a. Meanwhile, the internal side is the stupidity of some people about things that are part of Islamic law. The presence of a study on "Niqab According to the fiqh ulama of four madzhab" is expected to answer that problem. Especially in the Maqashid Syariah review, studies or books that focus on this issue are rarely found. Therefore, the author will explain the opinion of Madzahib Arba'ah and their arguments that prove the validity of the niqab, and explain Maqashid Sharia from the recitation. In this research, the writer will focus on researching the works of Ulama Madzahib Arba’ah. This study aims to reveal the views of Madzahib Arba'ah about the Niqab, and prove the compatibility of the arguments they use with Maqashid Sharia. In conducting this study the authors used the Comparative-Analysis Method, namely describing and comparing the opinions of Madzahib Arba'ah and the arguments they used in establishing the Niqab law. Then, this research is the Library Research, therefore what is examined and the data generated are ideas from the main sources, namely Madzahib Arba’ah's books. From this study, the authors conclude several points, including: The first, Madzahib Arba'ah has a different opinion between the obligatory and the sunnah in the matter of the Niqab, only they agree that the law becomes obligatory when a slander is feared. The second, Within the framework of maslahat, according to Shafi'iyah and Hanabilah, the Niqab case is included in the Hajiyat category, the reason is because in this case the potential to trigger slander. Whereas according to Hanafiah and Malikiah it was originally Tahsiniyat, this is because a woman's face is not genitalia. But if the opening of the face becomes the cause of the appearance of slander, then it is obligatory for women to close it, so that it rises to the level of Hajiyat mashlahat. From this it is clear that Madzahib Arba'ah's opinion on the Niqab issue is in accordance with Maqashid Sharia, so that some maqashid can be concluded, including: as an effort to prevent, slander, damage, maintain purity of the heart, maintain shame, avoid tabarruj, maintain stability living together, and protect the soul from disease.
