Abstract
The difficulty of meeting the needs of housing for most Indonesian people makes the Housing Loan (KPR) program much in demand. This program makes it easy for debtors / customers to have comfortable and safe housing at affordable prices and can be paid in installments. This study aims to determine the process, obligation, and regulations in a Home Ownership Credit (KPR) agreement between the bank and the debtor / customer and legal responsibility if one party makes a mistake on the implementation of a Home Ownership Credit (KPR). The method in this study uses a descriptive normative approach. Based on the results of the study showed that in the process of the mortgage agreement (KPR) the debtor / customer must first meet all the terms and conditions of the bank. The next thing is the signing of the deed of Home Ownership Credit (KPR), Notary / PPAT performs the name of the object certificate from the House of Ownership Credit (KPR) into the name of the debtor / customer but the certificate is handed over to the bank as collateral. Both parties have been bound by a Home Ownership Credit (KPR) agreement, so both parties must receive rights and also carry out obligations in accordance with what is stated in the Home Ownership Credit (KPR) agreement and may not conflict with applicable laws and regulations. If one of the parties is deemed to have committed a default or an act against the law can be prosecuted in the District Court.
