Abstract

Human needs are increasingly increasing, the more human beings need. The activity encourages negotiations as a relationship. In order to give legal permission to creditors both in the capacity of individuals and banking institutions in practice, the object of the Guarantee must be encumbered with a mortgage, which is contained in the Deed of Granting Mortgage Rights. Deed of Granting Mortgage Right (APHT) to the debt agreement and to study and explain the actions that can be taken by creditors against the debtor supported by default by displaying the Mortgage. This study uses normative discussion, research in relation to legal requirements, legal rules relating to the deed of granting mortgages to the agreement on receivables. This type of descriptive research is to discuss the deed of granting mortgage against the recipient's loan agreement. The results of the study show that the binding power of the Deed of Underwriting Right as a verification deed made before the officials involved in this matter PPAT and must be in accordance with the required agreements intended for debtors regarding breach of contract (default) Deed of Underwriting Deed as a perfect deed seen from Article 165 HIR can still be denied / paralyzed by the opposing party. In the event of disputes by the opposing party, the defendant has the burden of proof because what is contained in this deed is not in accordance with the reality of the matter.
