Abstract

The purpose of this study is to explain the process of mediating sharia economic disputes, and to understand the effectiveness of mediation in the settlement of sharia economic issues. The study was conducted at a surakarta religious court. In order to resolve the issue of sharia, the first means by litigation, the first by litigation, the first by non-litigation, or the second by non-litigation or non-litigation settlement. To settle disputes outside the court is greatly encouraged, because aside from reducing the issue going to court, an appeal outside court leaves the parties feeling defeated and no one feeling victorious.And so there is harmony in the society. One solution outside the court is by way of mediation. Mediation is a negotiated process between the two parties to find a solution to their dispute raised by the third party. Peace has also been mandated by article 130 hir /154 RBG, in the last chapter, the judge to attempt a peace between the two sides of the dispute. The Supreme Court then renewed its value as number 1 in 2008 with the new order number 1 in 2016 on a trial mediation procedure in which the court required that a pre-trial investigation and termination be performed first.
