Abstract

This study aims to determine the implementation of the franchise agreement on Sragen XXX Bread on Jln. Raya Sukowati No. 257 Sragen Tengah, Kec. Sragen, Kab. Sragen, and know the settlement made by the parties in the event of a violation and / or default. This research uses an empirical juridical approach. This research is descriptive in nature with the aim of providing complete data on legal protection for the parties and the provisions therein. The types of data used are primary and secondary. Based on the results of the study showed the implementation of the Sragen XXX Bread franchise agreement was in accordance with the contents of the agreement that was agreed upon. The agreement is in accordance with the provisions of Article 1320 of the Civil Code. The implementation of the franchise agreement on the Sragen XXX Bread is legal in the eyes of the law and made without coercion. The form of the contents of the agreement is in accordance with the manifestation of the principle of freedom of contract that has been regulated in Article 1338 paragraph (1) of the Civil Code, in making it free but for everything according to the nature of the agreement is required by propriety, customs or laws stipulated in Article 1339 of the Civil Code. Settlement of the defaults in the franchise agreement on the Sragen XXX Bread attempt to resolve it by means of a family consultation, and efforts to provide solutions. If these efforts are unsuccessful, the parties agree to choose the residence of the District Court.
