Abstract

Pawnshops are commonplace and commonly done by the community. Sharia pawnshop has mushed in all parts of Indonesia so that the Islamic community can make pawn transactions easily and avoid from RIBA. However, the community of Banaran village, Balerejo district did not consider it that way, for them to pawn the goods to the pawnshop takes a long time and difficult process. The pledge is used by the people of Banaran village in the classical way that is between residents and because of knowing each other. As for the collateral used in transaction pawn in Banaran village is by clearing the rice field because the majority of residents work as farmers. This research is to analyze the practice of the rice paddy field if it is reviewed from the perspective of Islamic law in Banaran village, Balerejo District, Madiun Regency. The type of research used is field research with a descriptive approach. The data collection methods used are observations, interviews, and documentation. Mode analysis used is a descriptive analysis. In terms of the utilization of pawn goods, the utilization of pawn goods in the village of Banaran Balerejo District Madiun, Law is Mubah. Because indirectly when Rahin had handed over his collateral he already knew and allowed his fields to be managed by Murtahin. It is also based on the Maliki and Shafi''i sects that allow Murtahin to make use of collateral if with a secret or required permission when Akad. Keywords: Gadai Sawah, Akad Rahn, Islamic law
