Abstract
Children become very valuable assets for a country in realizing the ideals of the nation and become an influential pioneer in determining the nation's development in the future. In order for the true ideals of the nation to be realized, a child in his growth and development is given the right in the form of education. Education is a mandate listed in the preamble to the 1945 Constitution, namely: protecting all nations and the whole of Indonesia's bloodstream to realize public welfare, educate the nation's life and participate in carrying out world order based on independence and eternal peace and social justice. Since it was first reported in 1987 until June 2018, the Ministry of Health noted the presence of HIV / AIDS has reached 433 (84.2%) of 514 districts / cities in 34 provinces in Indonesia and is most prevalent in the age group of 25- 49 years old and from other age groups are no exception in the city of Surakarta where there are some children with HIV / AIDS. Of the several children with HIV / AIDS there are some children who were expelled from school because of the disease. So in this case the children of HIV / AIDS get discriminated against their right to education. Children with HIV / AIDS do not get their rights as children in obtaining education.
