Abstract

Vehicle purchases on credit, especially in amounts that will not provide a solution to the needs of business operators. Due to the price of the vehicle purchased in a considerable amount, it is not affordable if it has to be purchased at a cash price, so that to overcome this problem comes the funding agency that appears to overcome this problem. This study aims to describe the Leasing Agreement with Fiduciary Guarantees at PT. BCA Finance in Surakarta. Juridical-normative Knowing Leasing agreements with Fiduciary Guarantees at PT. BCA Finance in Surakarta. This study uses the Statute Approach approach. The legislative approach is carried out to examine the rules governing leasing agreements. Types of doctrinal legal research. Legal research is a process of finding legal rules, legal principles and legal doctrines to answer the legal issues at hand. Doctrinal research (doctrinalresearch) is a research based on legal materials that focuses on reading and studying primary and secondary legal materials. The results of the study show that the form and content of the Leasing agreement with the Fiduciary Guarantee at PT BCA Finance Surakarta are in accordance with the definition of leasing according to Minister of Finance Decree No. 1169 / KMK.01 / 1991 dated November 21, 1991 concerning Business Leasing Activities. The responsibility of the parties to the Leasing Agreement with Fiduciary Guarantee at PT BCA Finance Surakarta, during the period of the lease, the Lessor guarantees that the Lessee will not get any interference / claim / claim from other parties outside of this agreement on the goods capital, which can interfere with the peace of Lessee in using capital goods to carry out its business in the field of transportation, the Lessee is obliged to pay taxes relating to capital goods and other costs related to the tax obligations, is obliged to maintain, maintain and maintain capital goods of the Lessor the lessee leases as well as possible as a legitimate owner of capital goods. In implementing leasing agreements with Fiduciary Guarantees at PT BCA Finance Surakarta, of course there are obstacles or problems that occur, including default and transfer of fiduciary goods to third parties.
