Abstract

Ijarah is a contract to transfer the right to use or benefit of goods / services within a certain limit with payment of wages (rent) without the transfer of ownership followed. The practice of ijarah in Pracimaloyo TPU, which researchers initially thought was not in accordance with the provisions of the DSN fatwa (National Sharia Council) NO: 09 / DSN-MUI / IV / 2000 and was not feasible for a wage-giving system for tomb cleaners in the TPU, so that researchers were interested in conducting research based on this study based on DSN fatwa theory. This study aims to obtain a detailed and clear description of the practice of ijarah in TPU Pracimaloyo whether it is in accordance with the DSN fatwa or not in accordance with the fatwa. So that the tomb managers who were given the mandate from the family of the tomb owners can find out whether the practice of ijarah carried out on the tomb cleaners at Pracimaloyo TPU is in accordance with the DSN fatwa (National Sharia Council) NO: 09 / DSN-MUI / IV / 2000. This research uses descriptive method, which is a research procedure that uses descriptive data in the form of written or oral words from people and actors that can be observed. This thesis research data is taken from interviews, pictures / photos, document analysis, and observation. After the data is collected, the researcher analyzes it using the DSN fatwa theory written by DSN-MUI. After the researcher conducted the research and analyzed the data based on the DSN MUI fatwa theory, the researchers concluded that the practice of ijarah conducted at the Pracimaloyo TPU was in accordance with the terms, harmony and provisions of the fatwa of the MUI DSN but unfortunately the amount of wages received by the tomb cleaners was not yet adequate to meet their needs .
