Abstract

This research is entitled "Analysis of Islamic Law Against Cash Endowments Contracts in Surakarta Ta'mirul Islam Islamic Boarding School". Cash Waqf is a new innovation in Islamic finance. One of the educational institutions that have practiced cash waqf is the Ta'mirul Islam Islamic Boarding School in Surakarta. Sources of funds obtained by the lodge are from santri, ustaz, guardians of student and the general public. From the practice, the implementation of cash waqf that occurs at a glance shows a difference between practice and theory or legal explanation, namely the presence of new representative policies so that it can be seen at a glance that there is no difference with infaq, namely contributions to cottage assets imposed on new student in particular, and old student in general. The existence of this policy has removed the obligation for student to contribute money to cottage assets. The waqf program means the transfer of student obligations, which must be transferred to endowments. In addition, there is a cash waqf program in the form of tin piggy banks managed by waqf institutions in Islamic Ta'mirul Islamic Boarding School, by distributing cans made of cans and distributed to student, ustaz and surrounding communities to be filled with the remaining coins they have then collected and recorded every month. With the existence of the waqf policy, the contract and statement (ijab qabul) which was originally an alms contract or infaq turned into a cash waqf contract. This study aims to find out and explain the cash waqf contract which is promoted by the Islamic Ta'mirul Islamic Boarding School based on Islamic law. This type of research is classified as field research or field research, using qualitative descriptive analysis methods, namely data analysis performed by describing in detail the reality or state of an object in the form of a sentence to provide an outline description to draw a conclusion. The practice of cash waqf contracts at the Surakarta Ta'mirul Islam Islamic Boarding School does not aim to pursue profits. This shows that the cash waqf contract in the lodge is commensurate with the usual waqf contract, which is included in the tabarru akad, because it is for good and help. In practice, they have fulfilled the requirements in the representation of wakif, objects that are represented, parties that have been given waqf assets and the existence of pledges on cash waqf and the existence of waqf managers (nazhir), namely ZISWAF PPTI. Another thing can be seen from one of the cash waqf contract cases in the hut, where the researchers observed that in accordance with Islamic law analysis the allowance for cash waqf programs that divert infaq donations must be endowments. This is permissible because on the basis of maslahah mursalah and from the purpose of waqf.
