Abstract

Light traffic accidents are accidents that cause damage to vehicles and / or goods. Medium traffic accidents are accidents resulting in minor injuries and damage to vehicles and / or goods. Heavy traffic accidents are accidents that result in death or serious injury. Perkap Number 15 of 2013, in Article 38 is regulated the procedure for investigating Traffic Accidents in accordance with the Criminal Procedure Law and provisions of legislation. The following is the procedure for collecting evidence of Laka, which is the evidence of witness testimony obtained from; a) Victim witnesses; b) Witnesses who see, hear, and know about the occurrence of a Traffic Accident. Expert testimonials obtained from people who have competence in the fields of: a) Judicial medicine or hospital doctors regarding the condition of the victim; b) Police forensic laboratory regarding identification of motorized vehicles c) Feasibility of function of motorized vehicles; d) Feasibility of road functions. Penal mediation by the Police is the implementation of all the rules stated in Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia. The reasoning mediation by the Police implied the public's response to the performance of the Police in dealing with the Laka case, because this mediation institution was actually a positive effort by the Police in resolving the Laka case and Alternative Dispute Resolution (ADR).
