Abstract

This thesis titled lease agreement rent room of kos Syafinah orally in Kelurahan of Kartosuro Pucangan reviewed of civil law and Islamic law. The execution of the lease agreement rent room kos Syafinah this is only conducted orally, so that less had the force of law and is difficult to do a proof in case of tort because the absence of written evidence, that vulnerable against the incidence of disputes and problems later in life. The problem in this research is whether the lease agreement rent room kos Syafinah in Kelurahan Pucangan's debt already fit according to civil law and Islamic law and how the tort happened in settlement lease agreement rent rooms kos syafinah orally in Kelurahan of Kartosuro Pucangan. The purpose of this research is to know the appropriateness and tort settlement agreement rent room kos Syafinah orally in Kelurahan of Kartosuro Pucangan according to civil law and Islamic law. The methods used in this research is descriptive research that means research that illustrates a particular object and explain things associated with or systematically describes facts or characteristics of the population in certain factual or closely. The results of this research are the lease agreement rent room of kos Syafinah orally in Kelurahan of Pucangan this is not suit both according to civil law or Islamic law because it did not meet the terms of valid agreements according to civil law as well as the tenets and terms in Islamic law. in practice there are problems that make the parties mutually feel aggrieved dispute resolution against the tort happened in kos Syafinah can be done in a non litigation, so the settlement is reached by way of a discussion or consensus in accordance with the procedures in force with such parties does not require a long time to resolve the dispute.
