Abstract

Sukuk ijarah is a financing that uses an ijarah contract system, or securities that contains a financing contract based on sharia principles issued by companies, governments, or other institutions that require sukuk issuers to pay income to sukuk holders in the form of rental assets and pay back sukuk principal funds at maturity Based on the above problems, a more in-depth study has been carried out on the implementation of the sukuk ijarah contract in terms of the DSN-MUI Fatwa, namely a review of Islamic law on the SR-006 2014 – 2017 th Series State Retail Sukuk in Indonesia. The type of research used by the author in this study is qualitative research. Qualitative research has the characteristics of applying inductive analysis, prioritizing the meaning behind the existence of reality, constructing the reality of socio-cultural meanings, interacting between events and processes, involving complex and difficult to measure variables, closely related to context, involving researchers in full, has a scientific background, uses purposive samples, and is always tested to question facts. Based on the results of the study, it can be concluded that based on the Fatwa of the National Sharia Council of the Indonesian Ulama Council Number 41 / DSN-MUI / III / 2004 concerning Ijarah Sharia Bonds that retail state sukuk issuance series SR-006 is in accordance with the MUI DSN fatwa and fulfills the requirement that Islamic bonds ijarah is a sharia bond based on the ijarah agreement with regard to the substance of the Fatwa of the National Sharia Council of the Indonesian Ulema Council Number 09 / DSN-MUI / IV / 2000 concerning Islamic finance. The Retail State Sukuk series SR-006 has obtained a Sharia Compliance Statement from the National Sharia Council-Indonesian Ulama Council with the issuance of sharia opinion with number: B-039 / DSN-MUI / II / 2014 dated 7 February 2014 on the issuance of Retail State Sukuk series 006. With the existence of the fatwa and DSN-MUI sharia opinion, there is a guarantee especially for sharia investors that investments in the Retail State Sukuk SR-006 series, including making purchases and trading them on the Secondary Market, do not conflict with sharia principles
