Abstract

The model of Islamic housing with istishna contract is currently being offered by sharia property developers in Indonesia, one of them is KPR Syariah Griya Safa Karanganyar. In this case, the buying and selling of istishna contracts has also been regulated by the Indonesian Ulema Council in its fatwa, namely fatwa Number 06 / DSN-MUI / IV / 2000 concerning the Istishna Agreement. The purpose of this study is to find out the fatwa review of the National Sharia Council in the contract of sale of sharia housing and settlement of problems of consumers who default on payments in KPR Syariah Griya Safa Karanganyar according to the fatwa of the National Sharia Council. This type of research is qualitative. The data used in this study is primary data from direct interviews with the owner of KPR Syariah Griya Safa Karanganyar. Secondary data obtained are in the form of books related to istishna ’agreement and fatwa of the MUI National Sharia Council. The method used is the interview and documentation method. Analysis of the data used in the study used a qualitative descriptive method. The results of the study prove that the practice of the Istishna sale and purchase contract in the Griya Safa Karanganyar Sharia housing is in accordance with the National Shari'ah Council Fatwa NO: 06 / DSN-MUI / IV / 2000 Concerning Istishna Sale and Purchase. Settlement of consumer problems that are in arrears in payments in the contract of the Istishna sale and purchase agreement Gri Griya Safa is in accordance with the DSN fatwa, because problem solving is done with family or discussion.
