Abstract
Legal construction in the franchise agreement on Surakarta Markoabar when viewed from the principle of the agreement implied in Article 1338 paragraph (1) of the Civil Code, namely the principle of freedom of contract. The article states that all agreements made legally, apply as laws for those who make them. To a certain extent, the provisions in the agreement agreed upon by the parties must be respected. Markobar is a contractor in implementing agreements with franchisees following the provisions of Article 11 PP No. 42 of 2007 states the obligation of the Franchisor to make a franchise agreement containing the identity of the parties, the type of franchise consisting of the brand, logo, management assistance, area placement, rights and obligations of the parties and the term of the agreement. The provision of management assistance carried out by Markobar as the franchisor follows the provisions of Article 8 PP No. 42 of 2007 also states that "Franchisors must provide guidance in the form of training, operational guidance, marketing management, research and development to Franchise Recipients on an ongoing basis". Supporting management or managerial support is continuous support from franchisors to franchisees throughout the contract period, in the form of: Human resource training (employees); Management operational guidance; Product quality control and management; Promotion and marketing; Research & development; Business evaluation.
