Abstract

Basically, a review is an extraordinary remedy provided to protect the interests of the convicted person, not the interests of the state or the victim in order to seek material truth. Further developments, the Panel of Judges of the Constitutional Court stated that Article 268 paragraph (3) of Law Number 8 of 1981 concerning Criminal Procedure Law, is contrary to the 1945 Constitution because it limits PK by the defendant only once. The Supreme Court as one of the highest judicial institutions in Indonesia determined its position by issuing SEMA No. 7 of 2014. One of the considerations of the Supreme Court in issuing the SEMA is related to one of the principles of criminal law, namely the principle of litis finiri oportet, namely that every case must be ultimately related to legal certainty. With the decision of the Constitutional Court, PK efforts can be done more than once, and will make the trial process that is not finished and not in accordance with the principle of opportunistic litis finiri. The purpose of this study was to describe the legal rules governing the process of review (PK) based on the Criminal Procedure Code and to explain the implications of the Constitutional Court Decision Number 34 / PUU-XI / 2013 on legal remedies more than once in criminal procedural law. In this study the author uses normative legal research methods that are carried out by examining library materials (library research), which is a legal research conducted by examining library material or secondary data or called library law research.
