Abstract

Savings and Loans Cooperative is one type of cooperative that has the main activity of providing storage and loan services to Cooperative Members. The purpose of this study was to find out the process of the loan lending agreement at the Bhina Usaha Savings and Loan Cooperative Branch of Ngawi Regency, applicable regulations, rights and obligations of both parties, and legal responsibility if one parties made a mistake in the loan. The approach method is a normative approach, which will examine the principles of law and legal rules of the existing regulations relating to money lending and borrowing agreements. The nature of the research used is descriptive research that will explain thoroughly and systematically about the agreement of lending and borrowing money in savings and loan cooperatives. The data source used is secondary data accompanied by field research to obtain primary data. The results of the study show that the agreement can be carried out if the Cooperative Member fulfills the administrative requirements and legal requirements provided by the Cooperative, after being fulfilled the Member fills out the agreement form, after an agreement and signing of the agreement arises the rights and obligations of the parties that must be implemented. Legal responsibility arises because of an error made by one of the parties who made the agreement. Errors can be based on Default or because of Unlawful Actions.
