Abstract

Visum et Repertum is necessary to know and reveal what really happened in a traffic accident. In revealing the case of traffic accidents, of course the police as investigators will make more careful efforts to find the material truth as complete as possible in the case. This study takes the formulation of the problem How does the role of Visum et Repertum at the stage of investigation in uncovering a violation of traffic accidents? and How is the validity of the investigation process, if the investigator does not conduct Visum et Repertum on the victims of traffic accidents? This research uses sociological juridical approach method, Primary data source obtained from field and secondary data source from documentation and legislation. While data collection techniques in the form of interviews with respondents / samples from traffic accidents and direct observation to the location of research in Satlantas Polresta Malang and the home of the victims of traffic accidents as the primary data collection. Then the data of the research are analyzed descriptively qualitative. Based on the results of the research, that Visum et Repertum as a written statement containing the results of an expert examination of the evidence in a traffic accident case, Visum et Repertum plays an important role to strengthen the evidence. In conclusion, the role of Visum et Repertum is, among other things, valid evidence, as evidence of suspect detention and as a matter of judge consideration. Suggestions, the need for the investigator to be more concerned and concentrated on the investigation mechanism, especially the examination of Visum et Repertum for the fulfillment of a material truth to be used as evidence that the validity can be accounted for.
