Abstract

ABSTRACT NINA ANGGRAENI. R 100160006. OMBUDSMAN REPUBLIK INDONESIA (ORI) AND PUBLIC SERVICE (Case Study of ORI Recommendation Analysis and ORI Recommendation Effectiveness). Thesis. Graduate School of Muhammadiyah University of Surakarta. 2018. Ombusdman is a state institution that has the authority to oversee the implementation of public services organized by state and government organizers including those held by State-Owned Enterprises (BUMN), Regional Owned Enterprises (BUMD) and State Owned Legal Entities (BHMN) as well as private or private entities which is assigned to perform certain public services which part or all of its funds are sourced from the State Budget (APBN) and / or Regional Budget (APBD). This study aims to 1) analyze the role of ORI in the settlement of public service disputes in Indonesia, 2) Describe the effectiveness of ORI recommendations in dispute resolution of public services in Indonesia, 3) Formulate an effective ORI recommendation model. This research is a normative juridical legal research. Data analysis technique is descriptive qualitative. The results of this study indicate: 1) The role of ORI in the settlement of public service disputes in Indonesia, is to receive reports of public service disputes from both government and private agencies, to investigate and report, mediate, clarify, give recommendation letters. 2) ORI recommendations in dispute resolution of public services in Indonesia, based on the results of research has not been effective. In terms of substance of inadequate regulation where in Law No. 37 of 2008 has not been able to optimize the implementation of the recommendations ombudsman. It is also influenced by the legal culture that is still low to comply with the recommendations of the ombudsman. 3) An effective ORI recommendation model is to grant more authority to the ombudsman by strengthening the Ombudsman Law of the Republic of Indonesia.
