Abstract

The police in enforcing the law do not escape the role of a witness both victim witnesses and witnesses from a third person, in this case the witness has the right to obtain protection through rights as stipulated in the Criminal Procedure Code and the Law on the Protection of Witnesses and Victims. This study discusses the discretion of the police regarding witness protection where in every criminal offense faced by the police also presents witnesses whose position as one of the two evidences. In the Law on Witness and Victim Protection, witness rights stipulated in article 5 paragraph (1) and paragraph (2) state that the rights stipulated in paragraph (1) can only be granted with the approval / decision of the LPSK ( Witness and Victim Protection Agency). After the research was conducted, the author argued that the Salatiga City Police had given rights to witnesses who were summoned in the case hearing process as stipulated in the Criminal Procedure Code and the Police provided protection to witnesses through the discretionary rights held by the police by giving witness rights only regulated in the Law on the Protection of Witnesses and Victims.
