Abstract

Determination of criminal acts in a special criminal law is of particular concern to the author, this is because in reality many special criminal laws that do not regulate the distinction between crime and violation as happened in Law No. 18 of 2013 concerning Prevention and Eradication of Forest Destruction, while in the Criminal Code which is currently the main criminal code in Indonesia, it still distinguishes the two types of criminal acts as general provisions. Although basically the special criminal law has the authority to deviate from these general rules. However, when a special criminal law which does not regulate general provisions concerning a crime to eat general provisions in the Criminal Code can be applied then what if the special criminal law which does not regulate the two types of crimes can reapply the general provisions in the Criminal Code, of course this will cause materially good juridical implications relating to the Criminal Code and formally relating to the Criminal Procedure Code.
