Abstract

Settlement of Case Against Law in Cooperation Agreement of Equity Participation and Credit Agreement (Case Study in Surakarta District Court)". University of Muhammadiyah Surakarta, Faculty of Law 2018. Research objectives in the problems to be studied are as follows; a) To explain the judge's consideration in determining the proof of a case of unlawful act in a capital investment cooperation agreement and a credit agreement; b) To describe judges in determining decisions on cases of unlawful acts in cooperative equity participation agreements and credit agreements. Result of Research of Decision Number 284 / Pdt. G / 2016 / Pn among others; a) that Defendant II, Defendant III, Defendant IV and Defendant V have made changes to the Board of PT. Wahana Sejahtera by violating the rules of Limited Liability Company as regulated in Article 105 in conjunction with Article 119 of Law no. 40 Year 2007 regarding Limited Liability Company; b) violates the provisions of Article 10 paragraph (1) letter c of Credit Agreement Number: 113 dated 29 July 2013 made by Notary Dra. JULY ASTUTI MR. SH. M. Kn. Notary / PPAT in Karanganyar Regency stipulating that: "Credit Recipient before this credit is paid is not permitted without written approval from the Bank to amend the Articles of Association and Management of the Company.
