Abstract

This study aims to find out the mainstreaming of children's rights in the enforcement of criminal law, the Implementation of the Mainstreaming of the Rights of the Child (PUHA) in material law and formal law and the judge's decision in implementing the Rights of the Child in criminal law enforcement. This study also includes the type of normative legal research with the method of content decision approach and secondary data type with research using the Decision of Surakarta District Court Number: 04 / Pid.Sus-Anak / 2017 / PN.Skt dan Number 05 / Pid.Sus-Anak / 2017 / PN.Skt. The results of this research indicate that the implementation of the mainstreaming of child rights (PUHA) in material law is contained in the law of child protection, the implementation of mainstreaming of child rights (PUHA) in formal law or criminal procedural law is contained in the law of the juvenile justice system and the judges' implementing the Rights of the Child in the enforcement of criminal law there are rights of the child against the law being violated.
