Abstract

The purpose of this study to know the Legal Protection of Children in Court Decision No. 201 / Pid.Sus / 2016 / PN.SKT and 26 / Pid.Sus / 2014 / PN.KB. and Barriers to the Implementation of Legal Protection of Children According to Law No. 23 of 2002 on Child Protection and its Solution, with the method of approach used in this study with qualitative analysis methods. Result of data analysis obtained that judge decision. 201 / Pid.Sus / 2016 / PN.SKT and 26 / Pid.Sus / 2014 / PN.KB that the judge has done can be known that in order to provide protection to the victim of the sale of the child, the Judge decided to give a serious punishment to the defendant ie 6 years in prison. Based on the case, this is in accordance with Law no. Law No. 23 of 2002 which regulates the sale of children, especially in articles 82 and 88. Barriers are Victims of child selling are individuals who suffer physically, mentally and socially because of the crime, even the victim may suffer from prolonged fear if he reports the perpetrators' offender in court. The criminal punishment system of the Indonesian Penal Code does not provide compensation for victims of child selling, so the position of women remains in a disadvantaged position as a crime victim. The solution or settlement of these barriers is as follows: victims of the crime of selling the child continue to be given good support from the family and community so as to eliminate the trauma for the crime that has happened to him and the victim obtain or obtain material compensation to finance various expenses incurred by the victim.
