Abstract

This study aims to determine the law enforcement of narcotic criminal acts in the military environment and the factors that influence the law enforcement of narcotic criminal acts in the military environment. Research method through empirical juridical approach method which is descriptive. The data sources consisted of primary data obtained from DENPOM V/1 Madiun and Military Court III-13 Madiun and secondary data derived from primary, secondary and tertiary law sources. Methods of data collection through literature study and interview then analyzed qualitatively. The results showed that the law enforcement of narcotic criminal acts in the military environment is done in a preventive and repressive manner that is not familiar with pretrial efforts and implemented through Military Justice instruments in accordance with Act No. 31 of 1997 on Military Justice, Kepmenkes RI No 194 Year 2012 on Laboratory Appointment Narcotics and Psychotropic Inspection, Law No. 35 Year 2009 on Narcotics, and Criminal Code. The consideration of military judges in imposing criminal verdict based on 2 (two) valid evidence plus the judge's conviction, but if minimal evidence of military judge can pass judgment on the basis of the instructions and TNI soldiers who violate the crime of narcotic abuse must get additional criminal sanction in the form of dismissal from the military service.
