Abstract

The lease agreement creates rights and obligations between the lessee and the lessor. Although it is clearly set up but still there are irregularities committed by the parties tenants, in the agreement it is commonly known as wanprestasi. Similarly, wanprestasi that occurred in the Rental Car Green, which addressed on the street Rajawali, number 5A Gonilan, Kartasura, Sukoharjo Central Java (57169). The existence of wanprestasi done by the tenant, then the Car Rental Green to make settlement action wanprestasi. The issue of this research is how the review of Islamic Law against the settlement of wanprestasi in the rental car Green. Is it in accordance with Islamic Shari'ah or not yet. Based on the analysis that has been researched by the researcher, Settlement of wanprestasi on car lease agreement in Rental Car of Green in the form of delay or violation of law that is not return or sell rental car by the tenant refers to letter of agreement that exist in Rental of Car Green is ask for change loss to the lessee as stated in the agreement on the rental car Green 10% per hour of the rental price per 24 hours, while for violation of the law that is not return or sell rental car made by the tenant, the Car Rental Green completed in a familial manner before reporting the incident to the authorities. It can be concluded that the practice of settlement of wanprestasi in Green Car Rental according to Islamic law is allowed and in accordance with the Shari'a. For indemnification and advocate for consultation before proceeding to the relevant authorities, the courts are in accordance with the National Shari'ah Council's Fatwa. 43 / DSN-MUI / VIII / 2004 on compensation (ta'widh).
