Abstract

The purpose of this research is to enlighten about implementation of imposition Mortgage Right of land Credit Agreement as arranged on Constitution No. 4 of 1996 about Mortgage Right of Land along with Valuable Object Related to the Land. It must be done throught two step. The first is giving Mortgage Right by debitor to creditor by making the Mortgage Certificate (APHT) by related official (PPAT). Second is registration state of Mortgage land office by publishing Mortgage Right. The aim of this research also to determine the problem that happen and how to overcome the problematigue of mortgage right, that is the mistake APHT or SKMHT writing, so the “Renvoi” must be done. Approaching method that used is jutidical empiric, the variation of method that used is descriptive. Kind of data that used consist of primary and secondary data. Interview and study document is the method to collecting data, then analyzed using qualitative analysis.
