Abstract

This study focuses on the issues of jurisprudence disputed by Majlis TarihMuhammadiyyah and LajnahBahsulMasaail, in the book of prayer. Taken from Kitab HimpunanPutusanTarjih and Kitab AhkamulFuqoha '. The purpose of this study is to provide a clear picture of the issues of jurisprudence disputed by both in the book of prayer, the causes of dissent, and how the opinion of the four imams of the school. This research is a descriptive qualitative literature research using comparison method. The findings on this issue are that there are ten points of disputed issues:Pronouncing niat before prayer,Text of prayer iftitah, Qunutnazilah, Qunutfajar, Qunutwitir, Addition of lafadzsayyidina in prayer, Numbering in particularjamaah in Friday prayer, Amount rakaat tarawih prayer, Place of prayer ied, and Qabliyah Friday prayer. The cause of differences of opinion between the two in the book of prayer are:Differences in the judgment of a hadith,The principles of ijtihad using qiyas, and Interpreting of Arabic utterances. In this case the opinion of the Majlis Tarjih in accordance with the Hanafi school in five problems, Maliki in four problems, Syafi'i in two problems, and Hanbali in seven problems, while LajnahBahsulMasail all their opinions in accordance with the school of Syafi'i. The issues that are disputed by both are ijtihadiyyah matters, therefore it should not be the cause of disunity, and it is permissible to get behind the people of different schools, but to regard an acceptable difference does not preclude the explanation of the truth, so for one who learns syar'i it is obligatory for him to follow the opinion he considers to be true, as for the layman it is obligatory for him to take the opinion of the one he regarded as the most pious and the most waro.
