Abstract

This study aims to determine the legal considerations of judges in resolving trade secrets disputes in the case Number 280/Pdt.G/2008/PN.Bks. The method used in this research is the method of legal research with doctrinal approach that is normative. This type of research is descriptive. Source of data include secondary law material that is in the form of Decision Number 280/Pdt.G/PN.Bks. Methods of data collection with literature study, then data are analyzed by deductive method. The results of the research indicate that the legal considerations of the Bekasi District Court judge Number 280/Pdt.G/2008/PN.Bks regarding Trade Secrets to elements: (a) information not known by the public in the field of technology and/or business has been in accordance with Article 1 paragraph (1) of the Trade Secret Law No. 30 of 2000 and the opinion of Yanni Lewis Paat; (b) has economic value as it is useful in business activities in accordance with Article 3 paragraph (3) of the Trade Secret Law No. 30 of 2000 and the opinion of Robert Patrick Merges; (c) to be kept confidential by the owner of the trade secret in accordance with Article 3 paragraph (4) of the Trade Secret Law No. 30/2000 and the opinion of Iman Sjahputra Tunggal and Heri Herjandono; (d) violations of trade secrets are in conformity with Article 14 of the Trade Secret Law No. 30/2000 and the opinion of Abdulkadir Muhammad.
