Abstract

This study aims to find out how the process of revocation of complaints and reports and legal consequences for the revocation of complaints and reports in investigation practice in Surakarta Police. The research method used is empirical juridical with analytical descriptive research type. Source of data consists of primary data that is result from interview and secondary data that is primary, secondary, and tertiary law material. Data collection method with observation and interview then analyzed qualitative. From the results of research shows that in a criminal case of processing the case hung on the type of offense that is the offense complaints and offense common. In ordinary offenses the case can be processed without the consent of the victim, even though the victim has revoked his report to the authorities, the investigator remains obliged to process the case. whereas in the offense of complaint, the legal consequences caused when the complaint is revoked, the prosecution becomes void, the withdrawal of the complaint against the offense of complaint becomes the absolute requirement to not prosecute.
