Abstract

This study aims to know: the role of the supervising officer community in the settlement of criminal cases by the child and the constraints faced by the Community Counselor in the settlement of criminal cases by the child. This research is empirical law research. Methods of data collection through library and field study. Technical analysis of this data is an interactive analysis. The results showed that Surakarta Central Penitentiary as one of the law enforcers especially in guidance of bad children, in carrying out its role is done through three stages, namely pre-adjudication stage, stage of adjudication, and post-adjudication stage. The barriers faced by the supervising officer community in the settlement of criminal cases by the child are: weakness of law rule that is applied to child crime, lack of coordination among law enforcers, low quality of human resources at Surakarta Central Penitentiary, lack of adequate facilities and infrastructures, the Surakarta regency's vast jurisdiction covering the former Surakarta residency has resulted in an inadequate role of the Central Penitentiary, the family of uncooperative child clients with supervising officer community, and very minimal budget and funding allocations.
