Abstract

This study aims to find out the implementation of the obligations of Land Deed Officials (PPAT) in the examination of the status of land in preparation for the sale and purchase of land and know the obligation of PPAT in examining the requirements of land sale in Klaten Regency. Research method through empirical juridical approach which is descriptive with data type consist of primary data that is interview and secondary data that is library. Methods of data collection by interview and literature study, then the data were analyzed qualitatively. Result of research indicate that PPAT and PPAT Meanwhile in Regency of Klaten already implement provisions Article 97 Regulation of Minister of Agrarian Affairs / Head of National Land Agency Number 3 Year 1997 concerning Implementation of Government Regulation Number 24 Year 2007 concerning Land Registration, that is checking or checking certificate conformity in advance to the Land Office because it becomes a requirement of the deed of buying and selling land. Any land dispute on the sale and purchase, most likely PPAT or PPAT While called to be a witness in the Court. PPAT or PPAT While not responsible for false data submitted by the parties or one of the parties in buying and selling land. But in practice, they do not want to get involved any further, in case of a deed made, they just want to give testimony to the deed he made. The legal consequences of data submitted to PPAT or PPAT While false, can be canceled. Similarly, land certificates issued on the basis of an unauthorized sale deed are, of course, invalid so they can be canceled.
