Abstract
Murabahah is one of contracts in sharia transaction. Murabahah contract is a mutual contract between two different parties, so this contract regulated in engagement laws. Murabaha contract received many judgments about the halal in practice and the implementation is considered to violate the rules of sale and purchase, where the goods have not owned by the financial institution but have been sold to customers in the form of installments for the distribution of funds so that financial institutions earn revenue in the form of margin. This research is to examine how murabahah contract is viewed from the perspective of law of engagement in Indonesia? And whether the murabaha agreement done in BTN Sharia Branch Office Yogyakarta has fulfilled the terms and conditions of sharia? The purpose of this research is to know the implementation of murabahah contract in sharia banks. This research uses descriptive research method with empirical juridical approach. Murabahah scheme is seen based on the law of engagement applicable in Indonesia as well as review on the basis of sharia rules is a relationship between ijab and kabul in accordance with the will of the Shari'a which establishes the legal effect on the object of the engagement. To ensure all legal consequences that occur after the murabaha agreement is accepted and implemented by the state is also not out of the rules of sharia law is believed.
