Abstract

Traditional Cultural Expression (EBT), based on the WIPO provides are the knowledge, know-how, skills and practices developed, maintained and passed down from generation to generation in the society, which often form part of the cultural or spiritual identity of the community. Traditional Cultural Expression (EBT) has a high economic value, but in the case of its ownership there has been a violation that is detrimental to the creator and the state, namely the claiming (recognition) by foreign parties without the author's permission or the Indonesian state as the owner of Traditional Cultural Expression, interests between owners and countries that claim. Traditional Culture Expression is stipulated in Article 38 of Law Number 28 on Copyrights. However, the regulation is less able to clarify the Expression of Traditional Culture. The formulation of the problem in this study discusses the related legal protection of Traditional Cultural Expression in the field of dance, and how the model of legal protection in the future. This study uses a kind of juridical-empirical research and qualitative methods.
