Abstract
The Constitutional Court as a high institution has the authority to examine the constitutionality of the law against the 1945 Constitution of the Republic of Indonesia. By that authority the Constitutional Court is often referred to as the protector of the constitutional rights of citizens. But in practice, the Constitutional Court often receives constitutional review cases but after examination the substance contains elements of constitutional complaint, such as the actions of public officials such as in the case Number 52 / PUU-XIV / 2016 and court decisions such as the case Number 01 / PUU-IV / 2006, The Constitutional Court is of the opinion that the constitutional impairment of the applicant is not due to the law but by the actions of the public official (concrete case) as well as the court ruling (concrete norm) and the Constitutional Court renders the verdict by declaring unacceptable. So it can be said that the authority of the Constitutional Court currently does not reflect the Constitutional Court as a protector of the constitutional rights of citizens.
