Abstract

This study aims to determine the process of settling the case of Home Ownership Credit and judge's consideration in determining the verification and determining the Decision on the case of Housing Loans at the State Savings Bank in the Surakarta District Court. The research method used the normative approach because the studied are the legal aspects, the principle in law, and the legal rules concerning the process of settlement of the mortgage loan case in Bank Tabungan Negara. This research is descriptive because it describes, describes and or arranges systematically and comprehensively about settlement process of house ownership credit in Bank Tabungan Negara submitted to District Court. The data sources consist of secondary data covering primary, secondary and tertiary law material, while primary data is interview result. Methods of data collection through literature study and field study (interview), after the data collected and then analyzed qualitatively. The results show that the process of settling the case through the examination, in which the Panel of Judges decides in this case to grant plaintiff's claim in part and refuse or not to accept other than and the rest. Judge's consideration in determining the evidence based on the arguments that have been proven by the Plaintiff and the Defendants, the Defendants have been declared as default in Article 1238 of the Civil Code. While the Judge's consideration in determining the Verdict due to the Plaintiff is able to prove the arguments of the lawsuit, the Panel of Judges gives the decision to grant the Plaintiff's claim in part, to punish the Defendant I to submit the Nilasari Housing Certificate to the Plaintiff without any condition, to punish the Defendant II to assist the transfer of right The Nilasari Housing Certificate to the Plaintiff, punishes the Defendants to pay a court fee of Rp. 1,081,000 (one million eighty one thousand rupiah) and refused the Plaintiff's claim other than and beyond.
