Abstract

Children as a doer of criminal act must get different enforced with adults. The government must give protection for children’s right that be faced by law. The problem statement of this research is the punishment for children as a doer in the traffic accident. The method that used in this research is empirical juridic. The process of the criminal act solution, especially in the traffic accident, where become the doer of traffic accident is children or teenager that still not yet mature. Punishment for children as a doer in the traffic accident must pay attention to children’s right in particular, based on various regulation boundary age said children that able to responsible the act for criminal act is at less than 18 years but more than 12 years. Procedure of solution law for children as a doer in the traffic accident is to pay attention to children Jurisdiction and children Protection, children Investigation, children Public Prosecutor, children Judge, Legal Advisor and Social Officer. Then throwing the criminal by The Children Judge at Children Jurisdiction with still pay attention to the best interest for children.
