Abstract

The victim is the most disadvantaged side in the case of traffic accidents, therefore the victim has the right to obtain compensation from the offender or the insurance company which take over the cases. In reality, both sides the victim and offender have not yet reached an agreement, so the fulfillment of indemnity of rights for victims by perpetrators is often overlooked. Law Number 22 Year 2009 on Road Traffic and Transportation does not regulate specifically on restitution of the offender for victims.This study is an empirical juridical study based on legislation, District Court decisions related to traffic accidents which are linked with field data on practices in restitution payments for victims of traffic accidents. The types of data used are primary data as well as secondary data covering primary, secondary, and tertiary legal materials. For method of collecting the data useddocuments study and field research method with the judge of District Court in Surakarta and Surakarta Police. Furthermore, the data analyzed using qualitative with deductive approach. Keyword: Victims, Traffic accidents, Restitution
