Abstract

This study aims to determine the extent to which the involvement of the perpetrators and victims of narcotic criminal acts and the obstacles faced by law enforcement in providing protection for the perpetrators and victims of narcotics crimes and the rights that must be given to victims of narcotic crime in the process of legal protection. The research method used descriptive juridical empiric method. The data source consists of primary data and secondary data that is primary and secondary law source. Methods of data collection through literature study and field study (interview and observation), then the data were analyzed qualitatively. The results concluded that the role of involvement of perpetrators and victims of narcotics crime as narcotics, narcotics couriers, narcotics dealers and victims as narcotics addicts. Constraints faced by law enforcers are almost no obstacles because the number of personnel sufficient, in addition the role of society is good in cooperation with Kapolresta Surakarta as reported narcotics crime and the community care and play an active role in the prevention and control of narcotics crime. Furthermore, the rights granted to victims of narcotics crime are given guidance for prevention and to carry out the rehabilitation process to be treated within 6 (six) months or more based on their addiction level.
