Abstract
The background of writing this thesis is the rampant of accusation divorce of wife to their husband in Religious Court Kajen. In general, divorce occurs because there is unresponsibility from husband to their wife. The issues raised in this research are how (1) the existence of TKW according to Islamic law and Indonesian law, (2) the factors become TKW (3) cause of accusation divorce. (4) the impact of the wife become a TKW in the family. And the results showed that (1) the background of the accusation divorce is caused mainly from low socio-economic families. (2) The factors become TKW caused by lack of economy, follow the footsteps of local community, ease of procedure to become TKI, want to get more big salary (3) the factors causing accusation divorce generally domination reason lack of responsibility husband, husband have another woman. (4) the impact of wife become a TKW will affect the child and husband. The benefits of this research are expected to contribute case insights and contribute more information on the practices of Islamic Law and Indonesian law, especially accusation divorce of migrant workers. This research is expected to be a scientific reference material for researchers about the factors causing divorce.
