Abstract

The child has the right of a name as an identity since birth. This self identity should be poured in a deed of birth certificate. Problems arise related to the birth certificate of an illegitimate child, where it is not easy to carry out a civil registration of a child that resulted from an extramartial relationship. So related to this, many cases of birth certificate falsification, one of them is in the case that happened in Sukoharjo regency, which ways by putting in the name of that child into another person’s family card that will be a problem in the future, especially the inheritance about the legal co nsequences of the birth certificate. The type of this research used by the author is descriptive research. In this study, the author uses the empirical approach. The author takes the location at the Department of Population and Civil Registration of Sukoharjo District. The purpose of this research is to describe the review or analysis of illegitimate children whose only having a civil relationship with his or her mother under Article 43 (1) of the Statute of Marriage and to explain the legal consequences for illegitimate children related to the falsification of birth certificate under Act of Marriage and Act No. 23 of 2006 about population administration.
