Abstract

This study aims to determine the registration of land and problematics as well as the role of the Kantor Urusan Agama (KUA) in the registration of wakaf land in Kebonsari sub-district of Madiun Regency. The research method used descriptive juridical empiric method. Sources of data consists of primary data ie interviews and secondary data namely primary, secondary and tertiary legal data. Methods of data collection through literature study and field study (interview), then the data were analyzed qualitatively. The results showed that the registration of wakaf land was in accordance with Article 4 of Government Regulation Number 28 of 1997 and in accordance with Islamic law. Problematic in the implementation, there is still a lack of understanding of the community regarding the registration and land of waqf land and do not want to register the wakaf land to BPN because the cost of expensive and wakif administration can not show on the rights of the land which is represented, it is necessary to have the policy of the government in the representation of the land, the utilization and wakaf land empowerment productively, need to socialize the importance of the implementation of waqf for economic empowerment of people. While the role of the Kantor Urusan Agama (KUA) Kecamatan Kebonsari Kabupaten Madiun is as Pejabat Pembuat Akta Ikrar Wakaf (PPAIW), but it also plays a role to facilitate people who want to mewakafkan land.
