Abstract

This study aims to determine the implementation of fiduciary guarantee in the financing agreement for the purchase of motor vehicles and legal consequences if the debtor wanprestasi in financing the purchase of motor vehicles with fiduciary guarantee in Bess Finance Purwodadi. The research method used descriptive juridical empiric method. Sources of data consists of primary data ie interviews and secondary data namely primary, secondary and tertiary legal data. Methods of data collection through literature study and interview, then the data were analyzed qualitatively. The results show that the implementation of fiduciary guarantee in motor vehicle financing agreement in Bess Finance Purwodadi in accordance with Law Number 42 Year 1999 regarding Fiduciary Guarantee. The debtor's default can result in the execution of fiduciary assurance without having to obtain a court decision because the fiduciary guarantee certificate has the same executorial power as the court decision which has obtained permanent legal force, without having to wait for the execution court's decision to continue. If the debtor or fiduciary is injured, the execution of the object to be the object can be done by executing the executorial title. If in the execution of fiduciary guarantee execution occurs the alienation of collateral by the debtor, then the Bess Finance may pursue legal proceedings with allegations of embezzlement of collateral goods.
