Abstract

The scope of human life in this world consists of two kinds of relationships, they are the vertical relationship to Allah SWT and horizontal relationship with human beings. Vertical relationship to Allah SWT in the form of charitable worship, then the horizontal relationship to human beings, especially in everyday life manifested in the form of reciprocal relationship among human beings. Then, the practice of reciprocal relationship must be in accordance with the Qur'an, As-Sunnah, and the Scholar Moslem Ijtihad. As for reciprocal relationship life, things that are often done by human is sale and purchase transactions. In this modern era, there are a lot of ways to develop business or trade, such as franchising. However in reality many businessman, especially franchises, who execute franchise system are only based on government regulations, not based on Islamic business principles to avoid speculation (Maysir), fraud (Gharar), Haram, usury(Riba), dangerous (dharar). So this research aims to describe clearly the issue of franchise agreement in the Islamic law perspective, In this case is food franchise in the business of Crunchy Molen Kress in the Gumpang Kartasura village to know the food business franchise system in the Islamic law perspective. The type of this research is field research, based on the type and purpose of this research is Descriptive-qualitative research that is to analyze and describe a state or phenomenon with words or sentences then separated based on category to obtain conclusion. Data are collected by using observation, interview, and documentation method, and analyzed by Inductive method. After doing this research, the researcher gets conclusion that in the implementation of the business agreement with the franchise system in the unit business Crunchy Molen Kress centered on Gumpang Kartasura has been in accordance with Islamic law.
