Abstract

This study aims to determine the process of debt agreement between debtors with Multipurpose Business Cooperation Sari Jaya and how the legal responsibility if there is a problem of debt agreement receivables and judge judgment in terms of termination dispute debt agreement receivables between debtors with Koperasi Serba Usaha Sari Jaya. The research method using descriptive normative juridical method. Sources of data consists of primary data ie interviews and secondary data namely primary, secondary and tertiary legal data. Methods of data collection through literature study and field study (interview), then the data were analyzed qualitatively. The result of the research concludes that the requirement of validation of the agreement is in accordance with Article 1320 of the Civil Code namely the existence of agreement between the two parties, legal competence, object or certain thing, causal or cause halal. Judge's consideration in termination of dispute on debt agreement between debtor and Multi Sari Jaya Business Cooperative by looking at the evidence both written evidence and testimony from the parties. Based on the evidence already attached to the hearing the judge decided to grant the claim of the ruler and stated that the defendant was found guilty.
