Abstract

ABSTRACT Banking is one of the economic centers that have intersects with human life because it concerns the prosperity of life. They take the advantage of the service form of the bank is credit to support the business to be better so as to improve the level of prosperity of life of the community. The formulation of this research is to know the implementation of the principle of freedom contract on the agreement of credit Bank and to know the clause of exoneration that is applied on the agreement of credit in Bank. The approach is using empirical juridical. The type of the research is descriptive qualitative. The methods of data collection are interview, observation, and documentation. The method of analyzing data is doing literature study. Based on the implementation of the freedom of contract on the agreement of credit in Bank has to be implemented thoroughly by way of working on the balance between the two parties that is Bank as creditor and customer as debtor. It implemented in order to achieve the implementation of the principle of freedom of contract on the agreement of credit Bank.
