Abstract

One of things that support health services in Government Hospital especially in government district hospital is good medicine and health tools stock availability. Good medicine and health tool stock availability is depends on medicine and health tool procurement process. Globally today, medicine and health tool procurements in government hospital Allegedly have many negative deviations. For example , few years ago many cases indicated that deviation, such as one of health minister became suspect of health tool corruption. One of ways that we can reach is in the process of the procurement. Who become the parts?, and the law rule that cover the procurement. Few years ago, procurement system through auction. But since Indonesia Government announced the new law rule system of medicine and health tool procurement namely Perpres No. 4 Tahun 2015, that all the parts of the procurement must be through E-Purchasing transaction. Everything is changing. All the parts should change the way and must follow the rule, one of the most important part is Government hospital and distributor. It is not only about perpres No. 4 tahun 2015, but also many rules should implement, namely Business ethics and internal rules of each part. This research will explore the effectiveness of the implementation of the new rule, namely, Perpres No. 4 Tahun 2015, other law rules of Indonesia country that can support medicine and health tool procurement, business ethics, and internal rule of government hospital director, such as Contract making. In this research also, the researcher uses qualitative methodology and socio legal research. This research uses primer data that taken from the object of research directly with observation and interview with Key Person Decision Maker (KPDM) in each part. Another data is secondary data that come from library, such as Perpres, business ethics, internal director rule, etc. The researcher take a sample study, namely transaction between Sukoharjo District hospital with PT. Enseval Megatrading, Tbk, Surakarta Branch. The researcher hopes can look and find the good way in the medicine and health tool procurement so that we can take a model for that procurement that can implement in other government hospital.
