Abstract

Marriage is a process of unification between a man and a woman to form a happy home and a prosperous, because the marriage is considered as a very important element in human life in order to continue towards a prosperous life. Basically marriage prevailing in Indonesia, both according to Islamic law or civil law is based both monogamous. The principle of marriage according to Islamic law is not absolute monogamy. This means that Islamic law does not forbid a man to have more than one wife (polygamy). Polygamy is usually done when in an emergency, for example if the wife is not able to perform his duty as a wife and could not give birth to offspring, as offspring are important in a marriage. Polygamy is permitted when applying for polygamy has qualified and procedures established by the legislation in force for the community, especially for Civil Servants. This study uses normative approach. Normative approach is examined in terms of legislation and sources of data used comes from secondary data. It can be concluded that the application for a permit polygamy for Civil Servants (PNS) must be in accordance with Law No. 1 of 1974, Government Regulation No. 10 1983 then Government Regulation No. 45 of 1990 on Marriage and Divorce Licensed for civil servants, if a civil servant (PNS) violate the provisions contained in the Act and PP (Government Regulation), it will be sanctioned and may be filed annulment of marriage.
