Abstract
Illegal online lending has become a serious problem in Indonesia in recent years. These lending practices are conducted online without adequate regulation and often involve unlicensed or unauthorized parties. This phenomenon creates vulnerabilities for customers who often lack understanding of the legal protection they should receive. This research aims to analyze the authority of the Financial Services Authority (OJK) in overcoming illegal online loan services based on Law No. 21 of 2011 concerning the Financial Services Authority and Law No. 4 of 2023 concerning Development and Strengthening of the Financial Sector. This research uses a normative juridical approach by referring to laws and regulations, court decisions, and related literature. The data obtained was analyzed descriptively to gain a comprehensive understanding of the existing legal framework. This method allows the research to explore the various aspects of the law governing online lending and how OJK can utilize its authority to protect consumers. The results show that OJK has significant authority in addressing illegal online lending services. OJK can provide a strong legal basis for customers to protect their rights through various regulations and enforcement actions. For example, OJK Regulation No. 77/POJK.01/2016 on Information Technology-Based Money Lending and Borrowing Services provides a foundation for OJK to conduct law enforcement against online loan service providers operating without a license. In addition, the lack of public understanding of the dangers of illegal online lending and the available legal protections is also an obstacle to law enforcement. This research provides insight that to effectively protect customers, there needs to be closer cooperation between OJK, the government and the community.
