Abstract
Outsourcing is the delegation of daily operations and management of a business process to an outside party (outsourcing service provider company). Through delegation, the management is no longer carried out by the company, but is delegated to an outsourcing service company. This study aims to determine the process of implementing outsourcing work between PT. Makmur Jaya Sragen as an Outsourcing service provider with Surakarta City Hospital as an Outsourcing service user and with outsourced workers, knowing the rules and rights and obligations between PT. Makmur Jaya Sragen with Surakarta City Hospital and with outsourced workers and know the legal responsibilities in the implementation of outsourcing work between PT. Makmur Jaya Sragen as an Outsourcing service provider with Surakarta City Hospital as an Outsourcing service user and with outsourced workers. This research uses a doctrinal or normative approach, namely an approach by examining library materials or secondary data or what is called library law research. This type of research is descriptive because the author will describe or explain the data as accurately as possible about the process of implementing outsourcing work between PT. Makmur Jaya Sragen as an Outsourcing service provider with Surakarta City Hospital as Outsourcing service user and with outsourced workers. The results showed that the process of implementing outsourcing work between PT. Makmur Jaya Sragen as an outsourcing service provider with Surakarta City Hospital as outsourcing service users and with outsourcing workers consists of several stages including the stage before the agreement, the stage at the time of the agreement and the stage after the agreement which has fulfilled the administrative requirements and legal requirements and is in accordance with Article 1320 of the Civil Code. Regulations related to outsourcing are regulated in Law Number 13 of 2003 concerning Manpower. The rights and obligations of each party have been regulated in the agreement, if there is one party who makes a mistake must be responsible based on default in article 1243 of the Civil Code or be responsible based on unlawful acts in article 1365 of the Civil Code.
